Whop helps us measure our ads using visits, device identifiers, and the name and email entered in our sales form, even before Continue.

Turning this off stops our advertising tracking. Checkout, saved progress, and service messages still work. Whop’s own checkout has separate privacy controls.

Terms of Service

Effective date: September 1, 2026

Applies to purchases and use of AI Customer Engine through evoward.com, grow.evoward.com, and related checkout, intake, scheduling, review, and service pages.

1. About these Terms

These Terms of Service govern your purchase and use of AI Customer Engine, a managed service offered by Evoward. "Evoward," "we," "us," and "our" mean the service provider operating under the Evoward business name. "You" and "Customer" mean the business or person purchasing or using the service. "End Customer" means a caller, lead, customer, or other person who communicates with your business through the service.

By purchasing, accessing, or asking us to begin providing AI Customer Engine, you agree to these Terms, the order or checkout terms shown to you, and any written scope that we both accept. If an order-specific written term conflicts with these Terms, that term controls for that order.

2. The service

AI Customer Engine is a managed system for home service businesses. The standard monthly plan includes the AI Booking Engine, Conversion Website, Automated Review System, CRM and Pipeline, and one-to-one onboarding and support. Depending on the configuration approved for your business, the service may answer inbound calls, collect job details, offer approved appointment times, book appointments, transfer selected calls, send approved follow-up messages, request reviews, display reviews, operate a conversion-focused website, and organize calls and estimate requests.

We configure the service around the information, accounts, service area, hours, availability, and instructions you provide. The exact phone, calendar, messaging, website, review, and workflow configuration is confirmed during onboarding or in writing. Features that are not included in the approved configuration are not part of the service.

AI Customer Engine supports your existing sales and operating process. You remain responsible for pricing, estimates, quotes, bids, proposals, service decisions, and closing work.

3. Setup approval and timing

After payment, you must complete the intake requested for your build and provide the access, content, and decisions reasonably needed to configure the service. Our standard build estimate is seven to ten days after we receive complete intake information. This is an estimate, not a guaranteed completion date. Missing information, delayed access, provider review, number provisioning, calendar configuration, or other dependencies may extend it.

We will present the configured system for a walkthrough or review. You must confirm that the business information, services, service area, hours, availability, call handling, transfers, messages, booking rules, and other customer-facing content are accurate before go-live. Reasonable corrections needed to match the agreed configuration are included. A new direction, material redesign, added pages, custom software, new integrations, or substantially expanded workflows require a separate written scope and may cost extra.

We do not intentionally put the system live before the required approval is recorded. Approval authorizes us to activate the approved configuration.

4. Subscription fees usage charges and taxes

The standard AI Customer Engine subscription is $299 USD every 30 days. The first charge is due immediately at purchase, and the subscription renews automatically every 30 days until canceled. There is no trial period, setup fee, or long-term contract unless a different written order clearly says otherwise.

AI usage is included in the monthly subscription. Phone numbers, calls, text messages, and other metered communications are charged separately based on actual use. Those usage charges may be collected through a connected service account or wallet and are not part of the $299 monthly subscription fee. Other third-party costs are separate unless the applicable written order expressly includes them.

Whop and its payment partners process subscription payments. You authorize them to charge the payment method you provide for the recurring fee, applicable taxes, and any separately disclosed charges. Evoward does not receive your full payment-card number. Prices exclude taxes that must be collected under applicable law unless checkout states otherwise.

5. Fourteen day guarantee

You may try AI Customer Engine for 14 calendar days beginning when your first subscription payment is completed. If the service is not a fit, email support@evoward.com within that period and request a refund. We will refund the full initial $299 AI Customer Engine subscription charge.

The guarantee applies once to the first subscription charge. Metered phone-number, call, text-message, and other third-party usage charges are separate and are not included in that refund. The guarantee does not limit any non-waivable refund right available under applicable law.

6. Cancellation

You may cancel the subscription at any time without a long-term commitment. Cancellation stops future renewals and normally takes effect at the end of the current paid billing period. You may cancel through the available Whop billing controls or by contacting support@evoward.com.

Except for the 14-day guarantee, a written order, or rights required by law, charges already paid for a billing period are not prorated or refunded. Canceling does not remove charges for metered usage already incurred.

When the subscription ends, managed call answering, messaging, booking, website hosting, automations, support, and connected features may stop. Provider-issued phone numbers, sending identities, platform accounts, or other third-party resources may not be transferable unless we confirm otherwise in writing. You should request any available export of your customer-specific content before the service ends.

7. Your responsibilities

You agree to provide accurate information, current instructions, timely decisions, necessary account access, and lawful content. You confirm that you have the rights and authority needed for us to use the business materials, trademarks, contact data, calendars, telephone numbers, customer records, reviews, and other information you provide.

You are responsible for reviewing the configuration and keeping your prices, services, locations, business hours, availability, policies, and escalation instructions current. You must monitor the service and promptly tell us about material errors, unsafe behavior, or changes that affect callers or bookings.

You are also responsible for laws and industry rules that apply to your business and communications. This includes required notices and consent for calls, text messages, email, automated communications, call recording, transcription, marketing, review requests, and handling personal information. You must honor opt-outs and suppression requests and must not use the service for unlawful, deceptive, infringing, abusive, discriminatory, or harmful activity.

8. Calls messages and artificial intelligence

The service uses automation and artificial intelligence. Automated responses can misunderstand a caller, produce an incomplete or incorrect answer, or fail because of network, carrier, provider, or configuration issues. You must not rely on the service as the sole channel for emergencies, urgent safety matters, or professional medical, legal, financial, or other regulated advice.

If call recording or transcription is enabled for your configuration, you are responsible for identifying the jurisdictions and notices or consents that apply to your calls. If follow-up text messages, emails, or review requests are enabled, you are responsible for ensuring that the recipients and messages are lawful and that required consent has been obtained. We may refuse or disable a configuration that we reasonably believe creates a legal, security, safety, or provider-policy risk.

Call transfer works only when the relevant telephone, carrier, provider, destination number, and team member are available. We do not guarantee that every call connects, transfers, produces an appointment, or results in paid work.

9. Customer and End Customer data

Our handling of personal information is described in the Privacy Policy. For information about you as a prospect, buyer, or account contact, Evoward generally decides why and how the information is used. For End Customer data that we process to provide the service under your instructions, you are generally the controller or business and Evoward acts as your processor or service provider.

You instruct us to process End Customer data only as needed to provide, secure, support, and improve the service and to comply with law. You must provide legally required privacy notices and respond to End Customer rights requests. We will provide reasonable assistance for requests involving data held on your behalf. If applicable law requires a separate data processing agreement, contact support@evoward.com before submitting regulated or sensitive data.

Do not submit or instruct the service to collect protected health information, full payment-card data, government identification numbers, account passwords, or other highly sensitive information unless we have expressly agreed in writing to the required handling.

10. Third party services

AI Customer Engine relies on third-party infrastructure, payment, scheduling, email, telephone, messaging, calendar, analytics, storage, artificial-intelligence, review, and other providers. Your use of a connected account or provider feature may also be governed by that provider's terms and privacy policy.

Third-party services may change, restrict, suspend, or discontinue features independently of Evoward. We may replace a provider or adjust a configuration when reasonably necessary to maintain the service, security, compliance, or functionality. We are not responsible for an outage or change outside our reasonable control, but we will use reasonable efforts to restore or provide a practical alternative for material included functions.

11. Ownership and permitted use

You retain ownership of the business materials and data you provide. You grant Evoward a non-exclusive license to host, copy, adapt, transmit, and otherwise use those materials only as reasonably needed to provide and support AI Customer Engine and comply with law.

Evoward retains ownership of its pre-existing and reusable software, prompts, configurations, templates, methods, workflows, designs, components, documentation, and know-how. Your active subscription gives you a limited, non-exclusive, non-transferable right to use the configured service for your own business. It does not transfer ownership of the underlying system or third-party technology.

Customer-specific content created for the service may be used within your business, subject to third-party licenses and these Terms. Any broader transfer, source-code delivery, domain transfer, or continued hosting after cancellation must be agreed in writing.

12. Confidentiality

Each party may receive non-public business, technical, customer, or operational information from the other. Each party will use that information only for the relationship, protect it with reasonable care, and disclose it only to people and providers who need it for that purpose or when law requires disclosure. This obligation does not apply to information that is public without breach, already known without restriction, independently developed, or lawfully received from another source.

13. Suspension and termination

We may suspend or limit the service when reasonably necessary because of nonpayment, excessive unpaid usage, unlawful activity, a security or safety risk, a material breach, inaccurate or harmful instructions, or a provider requirement. We will give notice when practical and restore service after the issue is resolved when restoration is reasonably available.

Either party may end the subscription as described in Section 6. We may terminate for a material breach that is not corrected after reasonable notice, or immediately when continued service would be unlawful or create a serious security, safety, or provider risk.

14. No guarantee of business results

We will provide the service with reasonable care and skill. We do not guarantee call volume, answered-call percentage, leads, estimates, appointments, reviews, rankings, sales, revenue, return on investment, customer behavior, or uninterrupted third-party service. Results depend on factors outside our control, including demand, your offer, reputation, staffing, availability, pricing, follow-up, and the accuracy of your instructions.

15. Warranty disclaimer and liability

Except for rights that cannot legally be excluded, AI Customer Engine is provided on an "as available" basis. We do not make implied warranties of merchantability, fitness for a particular purpose, or non-infringement beyond what applicable law requires.

To the maximum extent permitted by law, Evoward is not liable for indirect, incidental, special, punitive, exemplary, or consequential loss; lost profits, opportunities, goodwill, or data; End Customer claims caused by your instructions or legal noncompliance; or losses caused by third-party services, telecommunications failures, customer content, account compromise outside our control, or changes you make.

To the maximum extent permitted by law, Evoward's total liability arising from AI Customer Engine will not exceed the subscription fees you paid Evoward for the service during the 12 months before the event giving rise to the claim. This limit does not apply where liability cannot legally be limited.

16. Indemnity

To the extent permitted by law, you will defend and indemnify Evoward against a third-party claim arising from your unlawful content or instructions, your breach of Sections 7 through 9, your failure to obtain a required notice or consent, or your misuse of the service. This obligation does not apply to the extent a claim was caused by Evoward's breach of these Terms, gross negligence, or willful misconduct.

17. General terms

Neither party is responsible for delay caused by events beyond its reasonable control, including provider, carrier, internet, power, labor, government, disaster, or widespread security events. Payment obligations for services already provided are not excused.

You may not assign these Terms without our written consent, except as part of a sale of substantially all of your business assets. We may assign them as part of a reorganization, sale, or transfer of the relevant business. If a provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver.

These Terms, the applicable checkout or order, the Privacy Policy, and any written scope we both accept form the complete agreement for AI Customer Engine. Electronic records and communications may be used to administer the relationship.

The laws that mandatorily apply to your purchase remain applicable. Before starting a formal claim, each party agrees to contact the other and make a good-faith effort to resolve the issue. Nothing in these Terms prevents either party from seeking urgent relief or using rights that cannot legally be waived.

18. Changes and contact

We may update these Terms for future purchases. For an active subscription, a material change takes effect after reasonable notice and no earlier than the next renewal unless law or an urgent security or provider requirement requires otherwise. If you do not accept a material change, you may cancel before it takes effect.

Questions, cancellation requests, refund requests, and legal notices may be sent to support@evoward.com.
